Presenting the proposal for the establishment of My Hao town and 07 affiliated wards. Deputy Minister of Home Affairs Tran Anh Tuan stated that My Hao was the northern district of Hung Yen province, having favorable traffic position - an important transport hub of the Northern Delta between Highway 5A and Highway 39A. After many years of construction and development, My Hao district had achieved many achievements in socio-economic fields. In 2016, per capita income reached VND 68.9 million, the total state budget revenue in the province was over VND 3,700 billion; industries and services accounted for an average of over 96%; infrastructure is gradually synchronous; health and education reached national standards; social security was guaranteed; security, social order and safety were maintained; urban appearance was strong and increasingly prosperous.

Deputy Minister Tran Anh Tuan also said that the establishment of My Hao town and 07 affiliated wards met the conditions specified in Clause 2, Article 128 of the Law on Organization of Local Government and reached the standards defined in the Resolution no. 1211/2016/UBTVQH13 dated May 25, 2016 of the Standing Committee of National Assembly. Documents and procedures for establishment of My Hao town in Hung Yen province and 07 wards under My Hao town also met the requirements.

Giving opinions on the Proposal, the Standing Commission of Law stated that the establishment of a new urban administrative unit on the basis of upgrading the status of an administrative unit at the same level should be applied new regulations according to the Politburo's Resolution no. 37-NQ / TW. Accordingly, if any administrative unit has not reached 50% of both criteria namely natural area and population size, it must be subject to arrangement; and any unit that is not required to arrange in the period up to 2021 is still allowed to establish if it meets all the conditions and criteria prescribed by the current law; however, there must be specific reports and explanations on options, plans and the schedule for arrangement in accordance with the Party's guidelines. Therefore, the Government and People's Committee of Hung Yen province are requested to report and explain in detail the options, plans and the schedule for arrangement of My Hao town and affiliated administrative units directly under the town in the period of 2022-2030 in order to implement the Party's policy of administrative unit arrangement.

The Standing Committee of Law evaluates the documents submitted by the Government including the proposal, the project, the impact assessment report, the report of voters’ opinions and other attached documents. Thus, the documents have been fully complied with the provision in Clause 2, Article 133 of the Law on Organization of Local Government and Article 29 of Resolution No. 1211.

Based on the guidelines of the Party, the current laws as well as the actual socio-economic development and urbanization process in My Hao district, Hung Yen province, most of the opinions in the Standing Commission of Law approve the Government's proposal to establish My Hao town and 07 wards under My Hao town, Hung Yen province. However, in order to have a basis to report to the Standing Committee of the National Assembly, the Government and Hung Yen People's Committee are required to explain and clarify some contents. Specifically, explaining in detail options, the plan and schedule to arrange My Hao town in the period of 2022-2030; the state budget capital invested in the construction and development of My Hao urban area in the context of limited budget; the arrangement of organization structure and payrolls after establishing towns and 07 affiliated wards, especially arrangement of professional police team and police stations so as not to increase payrolls, nor the budget but still ensure the implementation of functions and tasks of the urban government apparatus.

The Standing Commission of Law proposed that the Resolution of the Standing Committee of the National Assembly would be enforced after 45 days from the date of adoption so that agencies, organizations and localities had time to prepare, consolidate organization, change the seal and necessary conditions for the operation of newly established administrative unit; at the same time, supplement and stipulate specific responsibilities of agencies and organizations in implementing the Resolution after being approved by the Standing Committee of the National Assembly./.
